Terms and Conditions for Real Estate Photography Services
Introduction
These Terms and Conditions (“Agreement”) constitute a legally binding agreement between [MIKES MEDIA HOUSE, MICHAEL DUNNETT] (“Photographer”) and [You The Employer] (“Agency”) collectively referred to as “Parties.” This Agreement governs the terms under which Photographer will provide real estate photography services to Agency.
Services Provided
Photographer agrees to provide real estate photography services to Agency, including capturing, editing, and delivering high-quality photographs of properties listed by Agency. The scope of services may include both interior and exterior shots as necessary to effectively showcase the property.
Copyright and Usage
Photographer retains full copyright ownership of all photographs produced during the project, including all rights to use, reproduce, and distribute the images.
Agency is granted a non-exclusive, non-transferable license to use the photographs solely for the purpose of marketing and promoting the listed properties. Agency shall not use the photographs for any other purpose without the express written consent of Photographer.
Agency shall not sell, sublicense, assign, or transfer the photographs to any third party without the prior written consent of Photographer.
Payment Terms
Agency agrees to pay Photographer for services rendered based on the pricing structure provided below.
Payment for services shall be made by the end of each calendar month for all services rendered during that month.
In the event that the total number of property shoots performed by Photographer for Agency in a calendar month exceeds ten (10), a discount of [X]% shall be applicable to the total invoice amount for that month.
Pricing Structure
The pricing for real estate photography services is based on an average-sized property with three (3) bedrooms.
Properties with five (5) bedrooms or more shall be classified as requiring additional time and effort, and therefore, shall be billed at a higher rate. Such properties shall be deemed to require a minimum of two (2) hours of photography work.
Cancellation and Rescheduling
In the event of cancellation by Agency within 1 hour of the scheduled shoot, a cancellation fee of 80% of the total quoted fee shall be applicable.
Rescheduling requests must be made at least [3] hours before the scheduled shoot. Failure to provide adequate notice may result in an additional fee.
Confidentiality
Both Parties agree to maintain the confidentiality of all non-public information exchanged during the course of the engagement.
Indemnification
Agency shall indemnify and hold Photographer harmless against any claims, liabilities, costs, and expenses arising from the use of the photographs.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of South Africa
Entire Agreement
This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements, understandings, or representations, whether oral or written.
By engaging Photographer’s services, Agency agrees to the terms and conditions outlined above.
