Wedding Media Contract
This Wedding Media Contract (“Contract”) is entered into on this [ ] by and between MIKES MEDIA HOUSE (“Company”), located at Amanzimtoti, and [ ], hereinafter referred to as the “Client,” . The Company and the Client shall collectively be referred to as the “Parties.”
1. Services Provided:
The Company agrees to provide wedding media services to the Client, including but not limited to photography, videography, and related media services, as described in the attached proposal. The scope of services, including the number of photographers/videographers, hours of coverage, and deliverables, will be as outlined in the proposal.
2. Payment:
The Client agrees to pay the Company the total sum of [ ] as specified in the proposal. A non-refundable retainer fee of [30%] is due upon signing this contract to secure the Company’s services for the specified date. The remaining balance is due [30 days before the event date].
3. Cancellation:
In the event of cancellation by the Client, the retainer fee shall be forfeited. If cancellation occurs within [7 Days] prior to the event. Cancellation must be made in writing.
4. Schedule and Changes:
Any changes to the agreed-upon schedule must be communicated to the Company at least [7 Days] before the event date. The Company will make reasonable efforts to accommodate changes, but there is no guarantee of availability for such changes.
5. Rights and Usage:
The Company retains the copyright to all media captured during the event. The Client will receive a non-exclusive license to use the media for personal purposes. The Client agrees not to sell or commercially exploit the media without prior written consent from the Company.
6. Model Release:
The Client grants the Company and its agents the right to use the media for advertising, promotion, and display purposes. If the Client does not wish to have specific media used in this manner, they must notify the Company in writing prior to the event.
7. Force Majeure:
If either party is unable to fulfill its obligations under this Contract due to circumstances beyond its control (such as natural disasters, acts of terrorism, or other unforeseen events), neither party shall be held liable for such non-performance.
8. Indemnification:
The Client agrees to indemnify and hold the Company harmless against any claims, actions, damages, or liabilities arising from the Client’s use of the media or any breach of this Contract.
9. Governing Law:
This Contract shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with this Contract shall be subject to the exclusive jurisdiction of the courts of South Africa.
10. Entire Agreement:
This Contract constitutes the entire agreement between the Parties and supersedes all prior agreements, oral or written. Any modifications to this Contract must be in writing and signed by both Parties.
